The User undertakes to guarantee and indemnify the SBR company against any damage or claim emanating from third parties resulting from the sending, distribution or transmission of content by the User or the use of the Site in an unauthorized or non-compliance with the provisions of this charter.

SBR reserves the right at any time to interrupt or suspend all or part of the Site or to modify, add or improve the services offered on the Site to improve the ease of use or enrich it, and this, without obligation of preliminary information, nor of any compensation.

The SBR company does not guarantee the conformity of the Site to a specific use or need, nor an operation free from interruptions, errors, disturbance, virus or failure, whatever the cause, case of force majeure, act of others or otherwise, nor the veracity, reliability or accuracy of the information posted or the results sought by the User.

SBR cannot be held liable for any direct or indirect damage resulting from the use or inaccessibility of the Site and in particular the lack of performance of the Site and/or software, loss, alteration or fraudulent access to data, failures in the Users’ installations, accidental transmission of viruses, conduct or harmful behavior of third parties, transactions made during the use of the Site, loss of profit or data, nor direct or indirect damages suffered by any third party due to the violation of their private rights by any content provided by the Users.

The Site contains links to other sites published by service providers outside the SBR company. These sites are operated by third parties, completely separate and independent of SBR. Not controlling in any way the activities, products or services offered by said sites, SBR cannot be held responsible for their content. All transactions, correspondence or operations on third-party sites are the sole responsibility of the publishers of the sites concerned.

The User is prohibited from copying, reproducing in number, extracting, digitizing or disassembling on any medium making it possible to reconstitute all or part of the files of the Site, to modify, to sell, to republish, to communicate, to distribute online or exploit directly or indirectly for commercial purposes, all or part of the elements of the Site, its services or any right of access to the Site.

The User undertakes to use the elements appearing on the Site only for private, non-collective and non-exclusive use, including a right of reproduction for storage for the purposes of representation on a single-user screen and reproduction in one copy, for back-up copy or hard copy. This right reserved for the exclusive use of the User is personal and non-transferable. Any unauthorized use of said elements subjects the offender to the civil and criminal penalties provided for by law.

This charter is subject to and interpreted in accordance with French law. Any dispute relating to the interpretation, execution and application of these conditions not settled in a transactional manner will be brought before the appropriate and materially competent court.

The SBR company reserves the right to subcontract or assign to a third party the rights and obligations arising from this charter. The fact that the SBR company tolerates the breach by the User of one of the obligations provided for by the charter, or not to apply any right whatsoever recognized to it by the charter, can in no way be interpreted as a waiver on his part to avail himself of his rights. In the event that any of the provisions of the charter would be considered illegal by a legal or regulatory provision, present or future, or by a court decision bearing the authority of res judicata and emanating from a competent court or body, said provision would be considered unwritten, all other provisions of the Charter retaining binding force between the parties.
